JetSNAPPED Terms of Service

JetSNAPPED operates an online platform that coordinates independent aviation photographers (“spotters”) to photograph aircraft operations and provides technology tools that connect pilots, aircraft operators, and aviation photographers.

The Platform allows pilots or aircraft operators to:

• Request photographic coverage of aircraft operations

• Receive photographs captured by independent photographers

• Upload flight schedules for automated photo matching

• Receive notifications when their aircraft is photographed

JetSNAPPED facilitates these interactions through technology services but does not provide photography services directly. All photography services are performed by independent photographers.

Users may be required to create an account to access certain features of the Platform.

Users agree to:

• Provide accurate and complete information

• Maintain the confidentiality of account credentials

• Notify JetSNAPPED of unauthorized account use

Users are responsible for all activity conducted through their account.

Eligibility

You must be at least 18 years of age to create an account or use the JetSNAPPED Platform. By creating an account or using the Platform, you represent and warrant that you are 18 years of age or older and legally capable of entering into binding agreements.

JetSNAPPED reserves the right to suspend or terminate accounts that violate these Terms.

Photographers listed on the Platform operate as independent contractors and are not employees, agents, or representatives of JetSNAPPED.

Photographers are solely responsible for:

• Capturing photographs

• Compliance with applicable laws and regulations

• Selecting lawful photography locations

• Delivering photographs to pilots or aircraft operators

JetSNAPPED does not supervise photographer activities and does not guarantee the availability or quality of photography services.

JetSNAPPED provides an on-demand platform that coordinates photographers to attempt to capture photographs of specific aircraft operations.

Pilots or aircraft operators may submit requests for coverage of aircraft movements including departures, arrivals, or other aircraft activity.

Due to the dynamic nature of aviation operations, JetSNAPPED does not guarantee that requested aircraft movements will be photographed.

Photographers may attempt to capture aircraft movements by:

• Monitoring flight status

• Tracking arrival or departure information

• Arriving early to the airport environment

• Positioning at common spotting locations

However, successful capture may be affected by, but not limited to:

• Flight delays or schedule changes

• Runway changes

• Air traffic control decisions

• Airport restrictions

• Visibility conditions

Submitting a request does not guarantee photographs will be captured.

JetSNAPPED may offer optional subscription-based services (“Premium Membership”).

Premium Membership may include features such as:

• Uploading flight schedules

• Automated matching of aircraft photographs

• Notifications when an aircraft is photographed

• Additional platform tools or services

Subscription payments are processed through Stripe, JetSNAPPED’s third-party payment processor.

Unlike on-demand photography transactions facilitated through the Platform, subscription payments are paid directly to JetSNAPPED.

Stripe collects subscription payments from users and distributes the full subscription fee to JetSNAPPED in accordance with Stripe’s payment processing terms.

Subscriptions may renew automatically unless cancelled.

JetSNAPPED reserves the right to modify subscription features or pricing.

JetSNAPPED may rely on third-party flight tracking services or publicly available aviation data.

Flight tracking data may be delayed, inaccurate, incomplete, or subject to change.

JetSNAPPED does not guarantee the accuracy or completeness of flight information displayed or referenced on the Platform.

JetSNAPPED may allow users to upload aircraft-related information including:

• Aircraft registration numbers

• Flight numbers

• Flight schedules

• Aircraft identifiers

Users represent that they have the right to provide this information.

Aircraft registration numbers, tail numbers, and related aviation data are public aviation identifiers and do not constitute private or proprietary information.

Users acknowledge that JetSNAPPED may use submitted aircraft information to operate platform features including photo matching, notifications, and aircraft indexing.

Payments for on-demand photography requests and photo purchases are processed by Stripe, a third-party payment processor.

By submitting or accepting a request or completing a photo purchase through the Platform, users authorize Stripe to process payments in accordance with Stripe’s terms and policies.

JetSNAPPED utilizes Stripe’s marketplace payment infrastructure to facilitate transactions between pilots, aircraft operators, and photographers.

Under this structure:

• Stripe collects payment from the requesting pilot, aircraft operator, or photo purchaser

• Stripe distributes funds to the participating photographer

• Stripe distributes JetSNAPPED’s platform commission to JetSNAPPED

JetSNAPPED does not receive, hold, or control user funds and does not act as a payment processor or escrow service.

JetSNAPPED’s compensation for facilitating transactions is limited to the platform service commission collected through Stripe.

Photographers acknowledge that payment timing and distribution are subject to Stripe’s processing schedules and policies. By accepting photography requests or listing photographs for purchase through the Platform, photographers acknowledge and agree to JetSNAPPED’s platform commission structure.

Pay What You Want

Photographers may elect to designate eligible on-demand offerings or photographs as “Pay What You Want.” For these offerings, purchasers may select the amount they wish to pay, subject to any minimum amount or other restrictions displayed on the Platform.

Before payment is submitted, the purchaser will be asked to review and confirm the selected amount. By confirming and completing the transaction, the purchaser acknowledges and agrees that the selected amount is the purchase price and authorizes Stripe to process payment for that amount.

Photographers who enable Pay What You Want pricing acknowledge that the amount paid is determined by the purchaser and may be lower than the Photographer’s standard pricing. Any applicable JetSNAPPED platform fees and Stripe payment processing fees will apply to the selected purchase amount in accordance with the fee structure applicable to the transaction.

Premium Membership Payments

Certain services offered through the Platform, including Premium Membership subscriptions, are paid directly to JetSNAPPED and are not subject to the marketplace payment distribution structure described above.

Photographers are responsible for any taxes owed on earnings received through the Platform.

Cancellation policies may vary depending on the photographer and the nature of the request.

Unless otherwise specified:

• Requests may be cancelled up to 24 hours prior to the anticipated aircraft movement for a full refund

• Requests cancelled within 24 hours may not be eligible for refunds

JetSNAPPED may assist with dispute resolution but does not guarantee refunds.

Photography activities coordinated through the Platform must comply with all applicable aviation safety regulations.

This includes compliance with:

• Federal Aviation Administration (FAA) regulations

• Airport authority rules

• Fixed-base operator (FBO) policies

Photography activities must never interfere with safe aircraft operations.

JetSNAPPED does not permit photographers to capture photographs for the Platform while located on, within, or accessing a military base, military installation, or other restricted military property.

Photographers may photograph military aircraft from lawful public locations outside of military installations, provided that the photography is otherwise permitted by applicable law and does not require unauthorized access to restricted property.

Users may not use JetSNAPPED to request, arrange, encourage, or facilitate photography that would require a photographer to enter or photograph from within a military installation or other restricted military property.

Photographers are solely responsible for ensuring that their photography activities comply with all applicable laws, regulations, property restrictions, security requirements, and instructions from military, airport, law enforcement, or other authorized personnel.

Pilots are solely responsible for the safe operation of their aircraft at all times. Under no circumstances should a pilot alter a flight path, maneuver an aircraft, deviate from applicable procedures, operate an aircraft in an unsafe manner, or otherwise prioritize obtaining photographs over the safe operation of the aircraft. All regulations under 14 CFR Part 1, 43, 61, 121, 135 should be complied with at all times.

JetSNAPPED does not request, direct, encourage, or endorse any flight activity intended to facilitate photography, and all decisions regarding aircraft operation remain solely within the Pilot's judgment and responsibility.

Photographers are responsible for ensuring their photography activities comply with applicable laws, airport regulations, and the applicable JetSNAPPED Photographer Agreement, which is incorporated into these Terms by reference.

Photographers must:

• Operate from lawful public areas or authorized locations

• Respect airport safety and security rules

• Avoid restricted airport areas unless authorized

JetSNAPPED does not supervise photographer conduct.

Photographers are solely responsible for their activities, safety practices, and any risks associated with photographing aircraft or operating in airport environments.

Photographers are responsible for delivering completed photographs to pilots or aircraft operators.

Delivery timelines may vary depending on the photographer and editing requirements.

JetSNAPPED does not guarantee:

• Delivery timelines

• The number of photographs delivered

• Specific photographic angles or results

All photographs represent the photographer’s best effort based on available conditions.

Photographers retain copyright ownership of all photographs they create unless otherwise agreed in writing.

Pilots or aircraft operators receiving photographs are granted a license for personal use unless additional commercial rights are purchased.

Users may not:

• Sell or distribute photographs commercially without permission

• Remove watermarks or copyright notices

• Use photographs for unlawful purposes

JetSNAPPED may display submitted photographs for promotional or marketing purposes unless otherwise agreed.

Aircraft owners or operators who believe photographs of their aircraft raise legitimate privacy or security concerns may request review for removal.

JetSNAPPED reserves the right, but not the obligation, to remove photographs in response to reasonable concerns.

Photographs captured lawfully from public locations are not automatically subject to removal.

Users agree not to:

• Use the Platform for unlawful purposes

• Misrepresent identity or qualifications

• Upload harmful or infringing content

• Interfere with the security or operation of the Platform

JetSNAPPED reserves the right to suspend or terminate accounts for violations of these Terms, or any reasons JetSNAPPED deems necessary.

Users agree not to circumvent the Platform by arranging photography services directly with photographers introduced through JetSNAPPED for the purpose of avoiding service fees.

Attempting to bypass the Platform may result in suspension or termination of accounts.

The Platform is provided on an “as-is” and “as-available” basis.

JetSNAPPED makes no guarantees regarding:

• Photographer availability

• Quality of photography services

• Delivery timelines

• Platform uptime

• Number of photo matches from pilot’s schedule

Use of the Platform is at your own risk.

To the maximum extent permitted by law, JetSNAPPED shall not be liable for:

• Indirect or consequential damages

• Loss of revenue or business opportunities

• Disputes between photographers and pilots

• Missed aircraft photography requests

JetSNAPPED’s total liability shall not exceed the amount of service fees collected by JetSNAPPED for the applicable transaction.

Users agree to indemnify and hold harmless JetSNAPPED, its owners, officers, and affiliates from any claims or liabilities arising from:

• Use of the Platform

• Violations of these Terms

• Violations of aviation regulations

• Disputes between photographers and pilots

These Terms constitute the entire agreement between users and JetSNAPPED regarding use of the Platform.

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions remain in full force.

Failure by JetSNAPPED to enforce any provision of these Terms shall not constitute a waiver of that provision.

These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles.
